TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using andywinsthemall.com ("the Platform"), operated by AndyWins ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and AndyWins. Your continued use of the Platform following the posting of any changes to these Terms constitutes your acceptance of those changes.

2. Eligibility

The Platform is available exclusively to individuals who meet all of the following criteria:

• You must be at least 19 years of age.
• You must be a resident of Canada or accessing the Platform from within Canada.
• You must have the legal capacity to enter into a binding agreement.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your age and location at any time. If we determine that you do not meet these requirements, we may immediately terminate your access without notice. Our age verification gate is one measure we use to help enforce this requirement.

3. Platform Description

AndyWins is a free social entertainment platform that offers arcade-style games, including Memory Match Mania, for recreational enjoyment. It is critical that all users understand the following:

• The Platform is entirely free to use. There are no purchases, subscriptions, or fees of any kind.
• All games on the Platform are for social entertainment purposes only.
• No game on the Platform has any monetary value whatsoever. Virtual scores, points, achievements, and progress hold no cash value and cannot be exchanged, transferred, or redeemed for anything of value.
• This is a free social game. The game does not offer the possibility of winning real money or prizes.

Game progress is stored locally on your device using browser localStorage (with the aw_ prefix). We are not responsible for data loss resulting from browser cache clearing, device changes, or other factors outside our control.

4. User Conduct

When using the Platform, you agree to the following rules of conduct:

• You will not use the Platform for any unlawful purpose or in violation of any applicable Canadian federal, provincial, or territorial law.
• You will not attempt to gain unauthorized access to any part of the Platform, its servers, or any connected systems.
• You will not use automated scripts, bots, scrapers, or similar tools to access or interact with the Platform.
• You will not harass, abuse, threaten, or intimidate other users through any community features.
• You will not upload, post, or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable.
• You will not attempt to manipulate game scores, leaderboards, or any other Platform features.
• You will not impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

Violation of these conduct rules may result in immediate suspension or termination of your access to the Platform, at our sole discretion.

5. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, game designs, animations, software, and the overall look and feel of the Platform, is the exclusive property of AndyWins or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from the Platform without our prior written consent, except for temporary copies made as part of normal browsing.

The AndyWins name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AndyWins. You may not use these marks without our prior written permission.

6. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY CANADIAN LAW, ANDYWINS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free. We do not warrant that any defects will be corrected. We make no representations about the accuracy, reliability, or completeness of any content on the Platform.

Your use of the Platform is at your sole risk. No advice or information obtained from AndyWins shall create any warranty not expressly stated in these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL ANDYWINS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Platform;
• Any conduct or content of any third party on the Platform;
• Any content obtained from the Platform;
• Unauthorized access, use, or alteration of your transmissions or content;
• Loss of game progress or locally stored data.

As the Platform is entirely free, our total aggregate liability to you for all claims arising from or related to the Platform shall not exceed one hundred Canadian dollars (CAD $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless AndyWins and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Platform, including but not limited to any content you submit through community features or contact forms, your violation of any law or the rights of a third party, or any use of the Platform other than as expressly authorized in these Terms.

9. Modifications

We reserve the right to modify these Terms at any time, at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page and post the revised Terms on the Platform. Material changes will be communicated through a prominent notice on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Platform immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province of Ontario, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or provincial courts located in Ontario, Canada, and you hereby consent to the personal jurisdiction and venue of such courts.

If you are a resident of Quebec, nothing in these Terms affects your rights under the Quebec Consumer Protection Act or the Civil Code of Quebec.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
